Official Rules for Expedia and the Korean Tourism Organization 2023 K-pop Event Campaign

 

The Expedia and the Korean Tourism Organization Campaign (the “Campaign”) is in no way sponsored, endorsed or administered by, or associated with Shopback (the “Marketing Platform”). You, the Participant, understand that you are providing your information to the Promoter and the Sponsor (defined below). The information you provide will only be used for the administration of this Campaign and in accordance with the Promoter’s privacy policies (see below). Any questions, comments or complaints regarding the Campaign must be directed to the Promoter, and not to the Sponsor and/or the Marketing Platform. You may only use one (1) Shopback Account  (“Platform Account”), and one (1) Eligible Booking, to participate in this Campaign.

 

In these Official Rules, the term “you” refers to any person who enters, or who wishes to enter, the Campaign.

 

1. Promoter:The promoter of this Campaign is Expedia, Inc., 1111 Expedia Group Way W., Seattle, Washington 98119 USA (”Expedia”), and the Sponsor of this Campaign is the Korean Tourism Organization.

 

2. Eligibility:The Campaign is open only to legal residents of Hong Kong SAR, Singapore and Malaysia (“Territories”) who are at least eighteen (18) years old at the date of entry and have a Platform Account and who otherwise meet the requirements set out in these Official Rules (“Participant”).  Employees of the Promoter or Sponsors, their subsidiaries, affiliates, prize suppliers and advertising/promotion agencies as well as their respective immediate family (spouse, parents, siblings and children and each of their respective spouses, regardless of where they reside) and household members (whether or not related) of those employees are not eligible to enter.

 

3. Campaign Period:The Campaign Period begins at 10:00 am Local Time 24 November 2023 and ends at 11:59pm Local Time 10 December 2023, or (ii) when the K-pop event tickets have been fully allotted by the Promoter in accordance with these Official Rules. 

 

4. Campaign Details:Up to 150 K-pop event tickets will be sponsed by the Sponsor, and the Promoter will on a first-come-first-serve basis allot 2 tickets per Participant for bookings for packages (hotel + flight) or hotels to South Korea in specific period, made on the dedicated Expedia Websites using the coupon code issued by the Promoter for the respective Expedia Websites during the Campaign Period (“Eligible Bookings”). Bookings made by a Participant before and/or after the Campaign Period will not be eligible. Promoter’s computer is the official time-keeping device for the Campaign. A Participant with an Eligible Booking will redeem the allotted K-pop event ticket subject to the safisfactory validation and verification by the Sponsor. Participants with an Eligible Booking may be required to submit to the Promoter and Sponsors his/her iternary number and name for the Eligible Booking on the Expedia Websites, in order to redeem the K-pop event tickets.  All decisions governing the redemption the K-pop event tickets shall be subject to the final discretion of the Sponsor. Participant shall release and not hold the Promoter liable for any and all claims, losses, damage, costs and expenses in connection with the Participant’s unsuccessful redemption of the K-pop event tickets.

 

5. Expedia Websites:shall refer to (i)  https://www.expedia.com.sg/lp/b/Kpopinspirearena (ii)  https://www.expedia.com.hk/lp/b/Kpopinspirearena (iii)  https://www.expedia.com.my/lp/b/Kpopinspirearena ; and (iv) the Expedia App for the Territories.

 

6. Particpant’s Responsibilities: Participant is responsible for paying all applicable federal, provincial, state, local, income and withholding taxes, if any. In the event that any tax withholding is required by law for the K-pop event tickets, the Participant authorises the Promoter to make the corresponding deduction.Any K-pop event ticket details not specified above will be determined by Promoter and/or the Sponsor, in their sole discretion. Participants may not transfer, assign or substitute the prize, or redeem prizes for cash, except at the sole discretion of the Sponsor, who reserves the right to substitute the prize (or portion thereof) with one of comparable or greater value. The K-pop event tickets must be accepted as alloted. The K-pop event tickets are allotted to the Participant with the Eligible Bookings “as is” without any warranty or guarantee, either express or implied by Sponsors and/or the Promoter.  The K-pop event tickets will be provided by the Sponsor. Specific K-pop event ticket details are at the discretion of the Sponsors.

 

The Participant is responsible for all other unspecified costs related to the K-pop event tickets, including meals, transport, insurance (including excesses), in-room charges,  taxes, mobile or data plans, installation costs, costs associated with ongoing use of the K-pop event tickets, etc.    

 

Participants accepts that some aspects of the K-pop event tickets may be inherently risky and that the K-pop event tickets may involve dangerous activities.  The Sponsor for the K-pop event tickets, its associated agencies and companies make no representation as to the safety, conditions or other issues that may exist at any destination. 

 

In respect of the K-pop event tickets, the Participant expressly acknowledge that undertaking such travel or activity is at the Particpant’s own risk and sole discretion and the Participant will make your own assessment of the risks and of your own suitability to participate in or to undertake such activity or travel.

 

7. Unclaimed K-pop event tickets:In the event the Participant fails to redeem his or her the K-pop event tickets  by such deadline stipulated by the Sponsor, or if after making reasonable attempts the Sponsor cannot verify the Participant’s Eligible Booking, the Participant will be deemed to have forfeited the K-pop event tickets and will not be entitled to any supplementary or replacement award or benefit.

 

8. General Conditions:In the event that the operation, security, or administration of the Campaign is impaired in any way, the Promoter may, in its sole discretion, suspend the Campaign to address the impairment and then resume the Campaign. Promoter reserves the right, in its sole discretion, to disqualify and seek damages from any individual who tampers with the operation of the Campaign, violates these Official Rules, or acts in a disruptive or unsportsmanlike manner. Promoter’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Proof of sending any communication to the Promoter or the Sponsors by mail shall not be deemed proof of receipt of that communication by the Promoter or the Sponsors (as applicable). The Campaign is subject to federal, state, and local laws and regulations, and is void where prohibited.

Where there is a dispute between you and Promoter and/or Sponsors  regarding the conduct of this  Campaign or claiming/redeeming the K-pop event tickets, the Promoter and/or Sponsors will endeavour to resolve the dispute with you. If the dispute cannot be resolved the Promoter and/or Sponsors’  decision in connection with all aspects of this Campaign is final.

 

9. Collection and Use of Your Personal Information: Promoter may collect your personal information directly or through our agents or contractors. We will use your personal information as necessary in order to conduct and manage the Campaign, and, where we have a lawful basis to do so, to send marketing communications to you. We may disclose your personal information to our related companies, agents, and contractors to assist in conducting and managing this Campaign, communicating with you, or storing data. This may include disclosures to organizations outside the Territories in places such as the United States.

10. Release and Limitations of Liability:Nothing in these terms and conditions restricts, excludes or modifies any consumer rights under any statute.

 

Without limiting the previous paragraph, by entering, you agree to release and hold harmless the Promoter and Sponsors, their respective parents, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Campaign or receipt or use of any prize, including, but not limited to: (a) unauthorised human intervention in the Campaign; (b) technical errors related to computers, servers, providers, or telephone, or network lines; (c) any errors on the Expedia Websites that may impact may entry; (d) printing errors; (e) lost, late, postage-due, misdirected, or undeliverable mail; (f) errors in the administration of the Campaign; or (g) injury or damage to persons or property. You further agree that in any cause of action, in no event shall the Released Parties be liable for attorney’s fees. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

 

11. Disputes:Participants agree that any and all disputes, claims and causes of action arising out of, or connected with, the Campaign or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court of England and Wales. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Promoter or the Sponsors in connection with the Campaign, shall be governed by, and construed in accordance with, the laws of England and Wales, without giving effect to any choice of law or conflict of law rules.
